Oppose ‘Mandate Relief’ – New Action Exec Board member

Testimony before New York State Regents opposing Proposal #1 mandate relief – to remove School Psychologists from CSEs.

Good evening, my name is Maria Ramos, I have been a School Psychologist for 16 years and before that I was a general education teacher. I am an employee of the NYC Department of Education. I am also an Executive Board Member of the United Federation of Teachers.

When I was 18 years old I volunteered to work at Willowbrook State School –  Some of you may remember the pictures of that school when in 1972 Geraldo Rivera revealed the autrocities of that place — and what I witnessed for my self – the horrendous conditions that children were subjected to —-I had to quit after only two weeks because it literally made me sick and depressed.  It was then I knew that I wanted to be part of the solution – so this would never happen again. As a school psychologist I have blown up into poster size  PL 94-142  of 1975.   I have it on my bulletin board in the parent teacher conference room. It is the guide to Least Restrictive Environment which states that “to the maximum extent appropriate, children with disabilities…are educated with children who are non-disabled”; and that special classes, separate schooling or other removal of children with disabilities from the regular educational environment occurs only when the nature or severity of the disability is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily.”

It is the school psychologist through the psychological educational evaluations,  observations, clinical interviews working with other staff members and parents, who determines the severity of the disability—and therefore we the school psychologists safeguard children’s rights to be educated in the least restrictive environment.

In conclusion I want to leave you with these words from Stephen Jay Gould in The Mismeasure of Man

“We pass through this world but once. Few tragedies can be more extensive than the stunting of life, few injustices deeper than the denial of an opportunity to strive or even to hope, by a limit imposed from without, but falsely identified as lying within.”

Our role as school psychologists and what we do is intertwined in the very civil rights of our children. And if this mandate relief is passed — I think it puts us on a very dangerous road that can lead back to Willowbrook State School.

New Action initiated a bipartisan resolution in support of our colleagues and all public workers in Wisconsin, and linking their struggle to our own. As soon as it is approved, we will publish it.

Without waiting for the resolution, we have proposed several specific steps for the UFT to consider taking:

  • Publicize what’s happening
  • Hold a press conference, and bring out lots of members to it
  • Request a voluntary $5 a member donation for a solidarity fund
  • Make a UFT $$$ contribution to our struggling colleagues
  • Set a “wear red for Wisconsin” day
  • Work with other NYC unions to build a demonstration in support for workers in Wisconsin

GOING FORWARD IN 2011 … OUR PRIORITIES

SCHOOL CLOSINGS
• We must organize a citywide fight to prevent these 50+ closings. This should be done at the same time each school mobilizes with the school community to beat back their own closings.
• We must guarantee that every school is informed and mobilized to join this fight. Each school must know that their school is next on the butcher block. Petitions must be circulated. The rank and file must be urged to attend PEP meetings and citywide rallies such as February 1.
• Chancellor Black should be trailed at all her public appearances and made aware that school closings are not an option. Our schools must be fixed not decimated to allow charters to open.
ABUSIVE ADMINISTRATORS
• Let’s end the reign of abusive administrators. Experience shows that ONLY collaborative relationships make for a healthy work environment that benefits staff and students.
• Too many Leadership Academy principals were hired by Bloomberg/Klein to get rid of veteran teachers, U-rate teachers, deny tenure and ignore the contract. In addition to targeting the worst abusers we need to modify the behavior of all abusive and troublesome administrators.
CONTRACT
• The City has put aside money to settle all contracts with public employees, including the UFT. The economic crisis has no bearing on the settlement of our contract, which is long overdue. The main obstacle is not money -which is there- but Bloomberg and Klein’s insistence that we give up senioirity and surrender on tenure and ATRs.
• WE DEMAND a parity contract: 4%, 4% with no givebacks.
• WE DEMAND that our ATRs are guaranteed a position and appointed to appropriate license areas within a district of their choice.
TENURE AND TEACHER EVALUATION
• WE OPPOSE tying tenure decisions to standardized tests. The negotiations on Race to the Top in New York State (as with states across the US) led to many dangerous concessions. 25% or 40% of tenure decisions will be based on student test results. This has the potential for disaster to our members.
• Tenure means due process rights. We have already witnessed serious setbacks to the 3020A process. We need to educate the public as well as our own members.
